A misguided Ohio couple recently found themselves incarcerated in lieu of $250,000 bail and facing robbery charges after posting pictures of themselves with stolen cash on Facebook.
It all started when the tattoeed John Mogan and his girlfriend Ashley Duboe decided to make some quick money by robbing a bank. On paper, their plan appeared to be sound. Duboe would assist Mogan by covering his extremely-recognizable-and-therefore-identifying tattoos that covered his arms, neck and face. Then, the previously tattooed Mogan would enter the bank, hand the cashier a note and leave with the money. In what is an increasingly rare event these days, everything went according to plan. John Mogan entered the bank, handed the cashier a note and walked out with the money. He and Duboe got away clean, nobody was hurt, and police were at a loss.
Then the duo posted pictures of themselves with their ill-gotten gains on Facebook.
In one picture, Mogan is apparently trying to take a bite out of the thick wad of cash. In another, he and Duboe are hugging each other and smiling as they flash handfuls of bills. In yet another photo, Mogan is holding a stack of bills to his face as though it were a telephone. Suffice it to say, the collection of photographs lead investigators directly to the couple.
In the State of California, robbery is covered under California Penal Code 211 PC and is always charged as a felony. First degree robbery carries a possible sentence of felony probation, 3 to 6-years in California state prison and/or a fine of up to $10,000. Second degree robbery includes possible sentences of felony probation, 2 to 5-years in California state prison and/or a fine of up to $10,000. Granted, the accused are in Ohio, and their penalties may not be exactly the same as California’s, at least you can get an idea of what the couple faces.
Also, John Mogan was recently released from prison prior to the robbery, so if convicted, the judge may not be lenient.
