What is Domestic Violence?

California’s Domestic Violence Laws make it illegal for someone to harm, or threaten to harm, and intimate partner. Many instances of domestic violence involve California Penal Code 243(e)(1), domestic battery, and California Penal Code 273.5 inflicting corporal injury on an intimate partner.

243(e)(1) PC, domestic battery, can be charged when someone willfully and unlawfully uses violence or force against an intimate partner (spouse, former spouse, fiance, dating partner, or co-parent. it’s possible to be charged with domestic battery even if you don’t actually harm the victim. What matters is that the defendant had the opportunity to use physical force or violence against the victim, and chose to do so. 243(e)(1) PC is a misdemeanor which includes the following penalties: up to one year in county jail, a maximum fine of $2,000, and in some cases, probation instead of jail time.

Penal Code 273.5 PC, inflicting corporal injury on an intimate partner is a “wobbler” that can be charged as a misdemeanor or a felony. When charged as a misdemeanor the potential penalties include: up to 1 year in county jail and/or a fine of up to $6,000. Felony convictions carry the potential penalties of 2, 3, or 4 years in California state prison and/or a fine of up to $6,000.

How to Bail Someone Out on Domestic Violence Charges

If a friend or loved one has recently been arrested on domestic violence charges, bailing them out of jail is easy. First, give us a call and provide us with the name, birth date, and the date and time of the defendant’s arrest. If not all of this information is available to you, we can still help you out. We use the information to locate the defendant within the jail system and verify their eligibility for bail. Once that has been established, you will need to fill out the short, simple bail bond application forms and sign the indemnitor’s agreement. Once that has been completed, we will dispatch one of our agents to the jail to post the bond. Your friend or loved one will then be released a short time later.
